Terms & Conditions

1. Provider

These Terms & Conditions apply to services offered by:

Marc Schalich
Steensweg 38
26419 Schortens
Germany

Email: info@celestipost.com

hereinafter referred to as “CelestiPost”, “we”, “us” or “our”.

2. Scope

These Terms & Conditions apply to all orders placed by consumers through the CelestiPost website at celestipost.com.

CelestiPost currently provides its services primarily to private customers.

Any individual agreements made with a customer take precedence over these Terms & Conditions.

3. CelestiPost Services

CelestiPost provides personalised radio-sending services.

Depending on the product selected, customers may submit:

CelestiPost Text Transmission

A personal text message that is converted into digital data and sent as a real radio signal using CelestiPost transmission technology.

CelestiPost Image Transmission

An image, together with optional accompanying text, that is converted into digital data and sent as a real radio signal using CelestiPost transmission technology.

Technical limits regarding message length, file size and permitted file formats are stated on the respective product page.

The exact scope, price and available options of the service are those displayed on the respective product page at the time the order is placed.

CelestiPost Gift Vouchers

CelestiPost offers gift vouchers for selected text and image transmission services. Depending on the voucher selected, the voucher covers the CelestiPost service specified on the respective product page, including the certificate option stated there.

The personal voucher code and PDF voucher are prepared manually and sent to the purchaser by email within one business day after successful payment. The voucher itself is delivered digitally only; no physical voucher is sent by post.

The voucher code may be redeemed for the CelestiPost service specified on the voucher and may generally be transferred to another person. Unless expressly stated otherwise, each purchased voucher code may be redeemed once. Cash redemption of the voucher value is not intended unless required by applicable law.

Purchased gift vouchers are subject to the applicable statutory limitation period. The date of issue is stated on the voucher.

Free promotional or campaign codes are not purchased gift vouchers. Separate usage conditions, validity periods and usage limits may apply to such codes.

4. Nature of the Radio Signal

CelestiPost performs an actual technical radio transmission using physical transmitting equipment and antennas.

The service provided by CelestiPost consists of the preparation, sending, technical verification and documentation of the radio signal.

The signal is not sent to a guaranteed individual recipient, geographical location or celestial destination. There is no guaranteed endpoint.

Radio propagation depends on numerous physical, technical and environmental factors. CelestiPost therefore does not guarantee:

  • any particular propagation distance
  • that the signal will leave the Earth’s atmosphere
  • reception at a particular geographical or extraterrestrial destination
  • reception by a particular person, organisation or device
  • reception or interpretation by extraterrestrial life
  • continuous propagation of the signal for any particular period of time

References on the CelestiPost website to space, stars, travelling outward, going beyond Earth or similar expressions describe the concept and intended direction of the service. They do not constitute a guarantee that a signal will reach a specific celestial body, location or recipient.

5. Technical Verification

CelestiPost technically verifies and documents the sending process using information that may include:

  • date and time
  • transmission identifier
  • message or file hash
  • transmission status
  • reception confirmation
  • signal strength or RSSI
  • other relevant technical data

CelestiPost uses its receiving station solely as a technical verification point.

The receiving station confirms that the radio signal sent by CelestiPost was received within the CelestiPost system and allows the received data to be compared with the original transmission data.

The receiving station is not the intended destination of the customer’s message.

Reception by the CelestiPost receiving station does not constitute evidence that the signal was received by an independent third party or at any particular destination in space, nor does it mean that the receiving station represents the endpoint of the radio signal.

6. CelestiPost Transmission Certificate

Following successful sending and technical verification, the customer receives a digital CelestiPost Transmission Certificate.

The digital certificate is included with every successfully completed CelestiPost transmission and is sent to the email address provided by the customer.

The certificate may contain information including:

  • date and time
  • transmission type
  • message or file hash
  • transmission status
  • reception status
  • technical reception information
  • order or transmission reference

The certificate documents the technical CelestiPost sending and verification process.

It is not a certificate issued by an independent scientific institution, governmental authority or third-party observatory.

Optional Printed Certificate

Where offered on the product page, the customer may additionally select a Printed Certificate by Mail.

This option includes a premium printed version of the CelestiPost certificate on high-quality paper.

The digital certificate remains included and is sent by email following successful completion and technical verification of the radio-sending service.

Worldwide postal delivery of the printed certificate is included in the displayed price unless expressly stated otherwise. Delivery remains subject to postal-service availability and applicable legal or territorial restrictions.

Depending on the destination country, postal delivery may take a few days to several weeks.

The postal delivery period is additional to the processing period for the radio-sending service.

No specific postal delivery date is guaranteed unless expressly agreed.

7. Customer Content

Customers may submit text and, depending on the selected product, images for sending.

The customer remains responsible for the submitted content.

By submitting content, the customer confirms that they have all rights and permissions necessary to provide the content to CelestiPost and to have it technically processed and sent for the purpose of performing the ordered service.

The customer grants CelestiPost only those rights necessary to:

  • receive the content
  • temporarily store it
  • technically process it
  • convert it into transmission data
  • send it
  • verify the sending process
  • create the corresponding technical documentation and certificate

No ownership of the customer’s content is transferred to CelestiPost.

8. Prohibited Content

Customers may not submit content that:

  • violates applicable law
  • infringes copyright, trademark, privacy or other third-party rights
  • contains unlawful threats or harassment
  • contains illegal sexual content
  • contains unlawful discriminatory or extremist content
  • promotes serious criminal activity
  • contains malicious software or technically harmful data
  • is otherwise unlawful to possess, process or transmit

CelestiPost reserves the right to refuse or cancel an order where there are reasonable grounds to believe that submitted content violates these requirements.

If an order is cancelled before performance for this reason, any refund will be handled in accordance with applicable law and the circumstances of the case.

9. Personal Data Contained in Messages

Customers should avoid submitting confidential or highly sensitive personal information unless it is necessary for their intended message.

Where submitted content contains personal data relating to another person, the customer is responsible for ensuring that they are entitled to provide that information for the requested service.

Further information is provided in our Privacy Policy.

10. Deletion of Submitted Content

Text messages and uploaded images are retained only for as long as necessary to prepare, perform and technically verify the sending process and to create the corresponding certificate.

After successful completion, technical verification and certificate preparation, the original message content and uploaded files are deleted.

Technical verification information, such as cryptographic hashes, timestamps, reception status and technical logs, may be retained separately for documentation purposes.

11. Prices and Shipping

All prices displayed in the CelestiPost online store are the prices applicable at the time the order is placed.

VAT is not charged or shown due to the German small-business exemption under Section 19 UStG.

The total amount payable is displayed before the customer submits the binding order.

No postal shipping costs apply to products containing only the digital CelestiPost service.

Where the customer selects the optional Printed Certificate by Mail, worldwide postal delivery is included in the displayed price unless expressly stated otherwise.

Gift vouchers are delivered digitally by email only and no shipping costs apply to the delivery of the voucher. Where a voucher entitles the recipient to a printed certificate according to its product description, worldwide postal delivery of that certificate upon redemption is included in the voucher.

12. Payment

Available payment methods are displayed during checkout.

Depending on availability, payment methods may include:

  • PayPal
  • credit card
  • debit card
  • digital wallets
  • bank-based payment methods
  • other payment methods offered through our payment provider

Payment processing may be carried out by PayPal or another payment service provider identified during checkout.

An order may only be processed after successful payment authorisation unless otherwise agreed.

13. Ordering Process and Conclusion of Contract

Product presentations on the CelestiPost website do not themselves constitute a legally binding offer.

For a direct CelestiPost transmission, the customer selects a service and any available certificate option, provides the required message and/or image and submits the order through the checkout process. When purchasing a gift voucher, the customer instead selects the desired voucher option; the message or image is submitted only when the voucher is later redeemed for the corresponding CelestiPost transmission.

Before placing the order, the customer can review and correct the information entered.

Where the customer requests performance before expiry of an applicable statutory withdrawal period, the corresponding declaration is requested separately on the product page before the product can be added to the cart.

The checkout clearly indicates that submitting the order creates an obligation to pay.

A contract is concluded when CelestiPost accepts the order, for example through an order confirmation or by beginning performance of the service.

14. Performance of the Service

CelestiPost performs the radio-sending service within three business days once all requirements for performance have been received.

These include:

  • successful payment
  • the required message and/or image
  • all information necessary to perform the service
  • where applicable, the customer’s express request for CelestiPost to begin performance before expiry of the statutory withdrawal period

For the purposes of these Terms, business days are Monday to Friday, excluding public holidays applicable at CelestiPost’s place of business in Germany.

The three-business-day period relates to the radio-sending service and does not include postal delivery time for an optional printed certificate.

No specific radio-sending date or time within those three business days is guaranteed unless expressly agreed.

Following successful sending and technical verification, the digital CelestiPost Transmission Certificate is created and sent to the customer by email.

Where a Printed Certificate by Mail has been selected, the printed version is subsequently prepared and dispatched to the postal address supplied by the customer.

Temporary delays may occur due to:

  • technical maintenance
  • equipment failure
  • network problems
  • weather conditions
  • power interruption
  • regulatory requirements
  • circumstances affecting safe or lawful radio operation
  • other circumstances outside CelestiPost’s reasonable control

Where reasonable, CelestiPost will perform the service as soon as the relevant problem has been resolved.

15. Technical Failure and Re-Sending

If a radio-sending process cannot be successfully completed or technically verified, CelestiPost may repeat the sending process.

Where the ordered service cannot be provided within a reasonable period, the customer retains all remedies available under applicable law, including a refund where legally required.

A temporary technical failure does not automatically constitute permanent non-performance if CelestiPost can reasonably repeat the sending process.

16. Right of Withdrawal and Early Performance

Consumers generally have a statutory 14-day right of withdrawal in relation to distance contracts, subject to statutory exceptions and conditions.

Detailed information is provided separately in the Withdrawal Policy.

CelestiPost normally performs the radio-sending service within three business days and may therefore begin performance before the statutory withdrawal period has expired.

For this reason, where applicable, the customer is asked on the product page to expressly request that CelestiPost begin providing the service before expiry of the withdrawal period and to acknowledge that the right of withdrawal may expire once CelestiPost has completely performed the service.

For operational purposes, CelestiPost regards the ordered radio-sending service as completed once:

  • the radio-sending process has been completed,
  • the process has been technically verified, and
  • the included digital CelestiPost Transmission Certificate has been created and sent by email.

Whether a statutory right of withdrawal has expired in an individual case is determined by the applicable law.

The purchase of a gift voucher is subject to the applicable statutory withdrawal provisions as described in the separate Withdrawal Policy. The delivery of the voucher code and PDF voucher alone does not constitute performance of the radio transmission service that may later be redeemed using the voucher.

Individually Produced Printed Certificates

The optional printed certificate is produced using the customer’s individual CelestiPost transmission and customer-specific transmission information.

Further details are provided in the Withdrawal Policy.

17. Electronic Withdrawal Function

Where the customer has a statutory right of withdrawal, CelestiPost provides an electronic “Withdraw from contract” function on its website.

The withdrawal function is accessible without requiring a customer account or login.

The customer is asked to provide:

  • their name
  • the order or contract number
  • an email address for the receipt confirmation

The customer can then submit the declaration using the “Confirm withdrawal” function.

After submission, an electronic receipt confirmation is sent to the email address provided. The confirmation records the submitted information together with the date and time of receipt.

Submitting the electronic withdrawal form:

  • does not automatically cancel an order,
  • does not automatically issue a refund, and
  • does not by itself determine whether the withdrawal is legally effective in the individual case.

CelestiPost reviews an incoming withdrawal declaration in light of the relevant order status and applicable law.

The electronic withdrawal function is an additional way of submitting a withdrawal declaration. Other legally permitted methods of declaring withdrawal remain unaffected.

18. Customer Cooperation

The customer must provide correct and complete information necessary to perform the service.

In particular, the customer is responsible for:

  • submitting the intended message or image
  • providing a valid email address
  • providing a complete and accurate postal address where a printed certificate is selected
  • checking submitted content before ordering
  • ensuring that uploaded files are technically usable
  • ensuring that submitted content complies with these Terms

CelestiPost is not responsible for errors or delays resulting from incorrect information or content supplied by the customer unless CelestiPost caused the error.

19. Changes to Submitted Content

Once technical preparation or sending has begun, changes to the submitted message or image may no longer be possible.

If a customer requests a change before the sending process begins, CelestiPost may attempt to accommodate the request but is not obliged to do so where processing has already started.

20. Intellectual Property

The CelestiPost name, website design, graphics, certificates, branding and other materials created by CelestiPost are protected by applicable intellectual-property laws.

Customers may use their personal CelestiPost Transmission Certificate for private purposes.

Commercial reproduction, modification or use of CelestiPost branding may require prior permission.

This does not affect ownership or rights relating to customer-submitted content.

21. Liability

CelestiPost is liable without limitation where liability is mandatory by law, including for:

  • intent
  • gross negligence
  • injury to life, body or health
  • liability under mandatory product-liability rules
  • guarantees expressly assumed by CelestiPost

In cases of ordinary negligence involving the breach of an essential contractual obligation, liability may be limited to the foreseeable damage typical for the contract, to the extent permitted by law.

Mandatory statutory consumer rights remain unaffected.

22. External Services

CelestiPost may use third-party services for purposes including:

  • website hosting
  • payment processing
  • email delivery
  • postal delivery
  • technical infrastructure

CelestiPost is not responsible for temporary disruptions or delays caused exclusively by external providers outside its reasonable control, without prejudice to mandatory statutory rights of the customer.

23. Availability of the Website

We endeavour to keep the CelestiPost website available and secure.

Continuous uninterrupted availability cannot be guaranteed.

Maintenance, security updates, technical failures or events outside our reasonable control may result in temporary interruptions.

24. Applicable Law

The law of the Federal Republic of Germany applies.

For consumers residing outside Germany, this choice of law does not deprive the consumer of mandatory protections granted by the law of the country in which they have their habitual residence where such protection applies under applicable conflict-of-law rules.

25. Dispute Resolution

CelestiPost encourages customers to contact us first if there is a problem with an order so that we can attempt to resolve it directly.

Customers may contact:

info@celestipost.com

Information concerning consumer dispute resolution will be provided where required by applicable law.

26. Severability

If any provision of these Terms & Conditions is or becomes invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.

Statutory provisions apply in place of any invalid or unenforceable provision.

27. Changes to These Terms

CelestiPost may update these Terms & Conditions for future orders where legal, technical or operational requirements change.

The Terms applicable to an order are those made available to the customer at the time the order is placed.
